Community Terms and Conditions
Effective Date: June 01, 2025
1. Acceptance of Terms
By subscribing to or otherwise using the CommunityWorkplace platform, you agree to be bound by these Terms and Conditions. If you don't agree, please don't subscribe to or use our services.
2. Subscription Fees
The monthly subscription fee is $149 USD, which will be automatically billed to your chosen payment method each month. Continued access to the platform requires timely payment. All fees are non-refundable, unless explicitly stated otherwise in writing by CommunityWorkplace.
Please note that subscription fees may change. We'll provide you with at least one (2) month's prior written notice of any fee changes. These new fees will only take effect after your community has agreed to them.
3. Access and Use
Your subscription grants your organization (e.g., a church, community group, or other qualifying entity) access to and permission to use the platform's features. This subscription allows your organization to provide access to the platform's features for its individual members, who will then be considered authorized users under your organization's subscription. These features include, but are not limited to, member profiles, job postings, a marketplace, and the "Start & Grow" resources. Please note that the "Start & Grow" resources are subject to their own specific Terms and Conditions. CommunityWorkplace may provide support and maintenance services as described on our website or in separate documentation, but is not obligated to provide any specific level of support beyond general platform availability.
4. Organizational Services and Member Donations
In addition to general platform features, the CommunityWorkplace platform facilitates your organization in offering various supplementary services to its members, such as assistance with creating an LLC, simple web page creation, accounting system setup, participation in networking events, and connections for tax filing support (collectively, "Organizational Services").
For these Organizational Services, members of your organization (congregation, community members, etc.) may choose to make a voluntary financial donation to your organization, rather than paying a commercial fee directly to CommunityWorkplace. You acknowledge and agree that:

a. CommunityWorkplace acts solely as a facilitator for the collection of these Donations on behalf of your organization.

b. All such Donations are intended solely for your organization and do not constitute payment for services rendered by CommunityWorkplace.

c. CommunityWorkplace will transfer the total collected Donations to your organization's designated bank account approximately thirty (30) days after the Donation is received by CommunityWorkplace.

d. Your organization is solely responsible for the accounting, tax implications, and legal classification of all Donations received from its members. CommunityWorkplace makes no representations or warranties regarding the tax deductibility or legal status of these Donations for either the contributing member or your organization.

e. Except for the direct services provided by CommunityWorkplace team members specifically under the terms of the separate "Start & Grow" Terms and Conditions, CommunityWorkplace does not provide the Organizational Services directly to members; rather, it provides the platform and tools for your organization to offer these services or connect members to third-party providers for them. CommunityWorkplace's role in facilitating connections to third-party providers for Organizational Services is limited to providing introductions or access to information. CommunityWorkplace is not responsible for, and disclaims all liability for, any acts, omissions, damages, or disputes arising between your organization's members and such third-party providers, or for the quality, accuracy, or suitability of services rendered by such third parties. Your members engage with any third-party providers at their own risk.
5. Intellectual Property
CommunityWorkplace retains all right, title, and interest in and to the platform, including all software, technology, content, trademarks, and any intellectual property rights related thereto. Your subscription grants only a limited, non-exclusive, non-transferable license to use the platform as permitted by these Terms. You retain all right, title, and interest in and to your organization's data and content uploaded to the platform ("Your Content"). You grant CommunityWorkplace a worldwide, royalty-free license to use, reproduce, modify, and display Your Content solely for the purpose of providing and improving the platform's services to your organization.
6. Member Data and Privacy
You are responsible for obtaining all necessary consents and permissions from your members for their data to be collected, processed, and used on the CommunityWorkplace platform. CommunityWorkplace will handle all data in accordance with our Privacy Policy, which is incorporated into these Terms by reference.
7. Content and Conduct
You are solely responsible for all content posted or otherwise made available by your organization or its members on the platform. This includes, but is not limited to, job listings, marketplace advertisements, and member profiles. All content must be lawful, respectful, accurate, and compliant with all applicable laws and our internal guidelines. CommunityWorkplace reserves the right to remove any content that violates these guidelines or is deemed inappropriate, in its sole discretion.
8. Marketplace Terms
The CommunityWorkplace Marketplace is provided solely as a venue to connect members of subscribed organizations who wish to advertise their businesses or sell products/articles. CommunityWorkplace's role is limited to providing the platform for such listings. You acknowledge and agree that:

a. CommunityWorkplace is not a party to any transactions between members in the Marketplace. We do not facilitate payments, deliveries, or returns, nor do we act as a broker, agent, or guarantor for any transaction.

b. Responsibility for Listings: Members are solely and entirely responsible for all aspects of their listings, including the accuracy, legality, quality, safety, and truthfulness of their advertisements, businesses, or articles for sale.

c. Transaction Responsibility: Members engaging in transactions via the Marketplace are solely responsible for verifying the identity, creditworthiness, and reliability of other members, as well as for the terms, conditions, and fulfillment of any agreements made between them. All transactions are conducted at the members' own risk.

d. Compliance with Laws: All listings and transactions in the Marketplace must comply with all applicable local, national, and international laws, including but not limited to consumer protection laws, advertising regulations, and laws pertaining to the sale of goods or services.

e. Disclaimer of Liability: CommunityWorkplace is not responsible for, and expressly disclaims all liability for, any loss, damage, injury, dispute, or claim arising from or related to any listings, advertisements, businesses, articles for sale, or transactions conducted through the Marketplace. This includes, but is not limited to, issues regarding product quality, delivery, payment, misrepresentation, or any failure to fulfill a transaction.

f. Right to Moderate: CommunityWorkplace reserves the right, but has no obligation, to monitor, review, or remove any Marketplace listings or content that we deem, in our sole discretion, to violate these Terms, our content guidelines, or any applicable laws.
9. Start & Grow Program Terms
The "Start & Grow" program offers resources and guidance designed to support the business development of your organization's members. Your participation in and reliance on any aspects of the "Start & Grow" program are subject to these specific terms. CommunityWorkplace's role is to provide informational guidance, tools, and connections, not to provide professional legal, accounting, tax, financial, or business advice. CommunityWorkplace may, at its discretion, suggest or provide connections to third-party service providers if a deeper or more advanced solution is needed concerning any aspect of the "Start & Grow" program. However, CommunityWorkplace does not endorse, guarantee, or assume responsibility for the services provided by such third parties, and your engagement with them is solely at your own risk.

a. Guidance in Creating an LLC Company:

CommunityWorkplace may provide general guidance, information, or resources related to the process of forming a Limited Liability Company (LLC). For certain steps, CommunityWorkplace may use Anydesk (a remote desktop application that allows us to access the member's computer with the member's explicit permission) to guide the member through filling out necessary forms and initiating payments for official company registration fees.

When the member needs to input banking information for these payments, the member will be instructed to temporarily disconnect the Anydesk session to ensure their banking details (including debit cards, credit cards, or other means of payment) are not visible to CommunityWorkplace.

This guidance is for informational purposes only and does not constitute legal advice or the formation of an LLC on your behalf.

You are solely responsible for all costs associated with LLC formation, including state filing fees, attorney fees, and any other expenses.

You are solely responsible for ensuring the accuracy and completeness of all information submitted for LLC formation, for complying with all applicable state and federal laws, and for maintaining the LLC's legal standing. CommunityWorkplace makes no guarantees regarding the successful formation of an LLC or its suitability for your specific needs. You should consult with a qualified legal professional for personalized advice.

b. Basic Setup of an Accounting System (Subscription Required):

CommunityWorkplace may provide assistance with the basic setup of an accounting system.

Member's Responsibility for Subscription: The member will be responsible for purchasing a monthly subscription to an accounting software (e.g., QuickBooks), depending on their chosen plan and available options. CommunityWorkplace will guide the member through the process of purchasing this subscription using Anydesk.

Anydesk Use for Setup: For this assistance, CommunityWorkplace may use Anydesk to remotely guide the member through the setup process on the member's computer.

Included Setup Assistance: This setup assistance includes:

Configuring the chart of accounts.

Entering beginning balances.
-
Setting up formats for printing.
-
Linking bank accounts.
-
Generating basic reports.

Privacy During Sensitive Input: When the member needs to input banking information for purchasing the software subscription or linking bank accounts, the member will be instructed to temporarily disconnect the Anydesk session to ensure their banking details (including debit cards, credit cards, or other means of payment) are not visible to CommunityWorkplace.

Scope of Service - No Ongoing Bookkeeping: This assistance does not include ongoing accounting services, bookkeeping, financial analysis, or tax preparation.

Member's Overall Responsibility: You are solely responsible for the accuracy of all financial data input into the system, for ensuring proper accounting practices, and for complying with all relevant accounting and tax laws.

Disclaimer: CommunityWorkplace does not endorse any specific accounting software, and we are not responsible for any software errors, data loss, or the financial outcomes of your accounting practices. You should consult with a qualified accounting professional for personalized advice.

c. Basic Creation of a Web Page (Landing Page, About Us Page, Contact Form):

CommunityWorkplace may provide assistance with the basic creation of a simple website consisting of a landing page, an "About Us" page, and a contact form. For certain setup and integration steps, CommunityWorkplace may use Anydesk to access the member's computer and guide you through processes like connecting to web hosting services or setting up platforms such as Wix. The member will be responsible for initiating any payments related to web hosting or platform subscriptions (e.g., Wix fees) using the member's own banking information, including debit cards, credit cards, or other means of payment.

This service is limited to the initial setup of these specified pages and does not include advanced design, custom functionality, ongoing maintenance, content creation, domain registration, or web hosting beyond what is inherently part of the platform's capabilities.

You are solely responsible for the content, legality, accuracy, and upkeep of your website. CommunityWorkplace is not responsible for the performance, security, availability, or any disputes related to your website.

d. "Dream It, Do It" - Novelty Business Idea Posting:

This section allows members to post novelty business ideas with the potential to attract interest from investors within the community.

CommunityWorkplace serves solely as a bulletin board or forum for posting ideas and connecting members. We do not vet, endorse, or guarantee the viability, originality, or success of any posted idea.

You are solely responsible for the content you post, including its accuracy and any intellectual property implications. Posting an idea publicly may affect its patentability or other intellectual property protections. You disclose ideas at your own sole risk.

CommunityWorkplace does not vet, endorse, or verify the credentials, reliability, or intent of any potential investors. We are not a party to any discussions, negotiations, or agreements that may arise between members and investors, and we are not responsible for any outcomes, disputes, or damages resulting from such interactions.

e. Invitation for Networking Event:

CommunityWorkplace will issue an invitation for one networking event per year.

Participation in these events may require separate registration and involve additional logistic fees, which will be communicated in advance and are your sole responsibility. Such fees are non-refundable unless otherwise specified for that particular event.

You are solely responsible for your own safety, conduct, and interactions with other attendees at any networking event. CommunityWorkplace is not responsible for the actions of other participants or for any outcomes or damages arising from your attendance at these events.

f. Connection to Volunteer Income Tax Assistance (VITA) Program for Federal Tax Filing (Individuals only):

CommunityWorkplace may provide connections to physical locations where individuals can receive free federal tax filing assistance through the Volunteer Income Tax Assistance (VITA) program.

CommunityWorkplace does not charge any fee for facilitating this connection to the VITA program. This service is not covered by your organization's monthly subscription fee, nor does CommunityWorkplace accept any donations for this specific service from members or the organization.

This service is explicitly limited to connecting eligible individuals to the VITA program and providing the physical location for assistance.

CommunityWorkplace does not provide tax advice, tax preparation services, or endorse any specific tax outcomes.

You are solely responsible for determining your eligibility for the VITA program, for providing accurate and complete information to VITA volunteers, and for the accuracy of your filed tax returns.

CommunityWorkplace is not responsible for any errors, omissions, tax liabilities, audits, or any disputes arising from services provided by the VITA program or its volunteers. The VITA program is an independent third-party service, and its terms and conditions apply.

g. General Disclaimer for Start & Grow Program:

All services within the "Start & Grow" program are provided "as is" and without any guarantees of success, profitability, legal compliance, or specific outcomes.

CommunityWorkplace explicitly disclaims all liability for any direct, indirect, incidental, special, consequential, or punitive damages, or any losses of any kind, arising from your participation in or reliance on any aspect of the "Start & Grow" program. This includes, but is not limited to, losses related to business formation, financial decisions, intellectual property, investments, or tax matters.

You are strongly advised to seek independent professional legal, accounting, tax, and financial advice before acting on any information or engaging in any activities related to the "Start & Grow" program.

10. Termination
Either party may terminate this subscription agreement by providing at least 30 days' prior written notice to the other party. No refunds will be issued for early termination. Upon the effective date of termination, your organization's access to the platform will immediately cease.
11. Modifications to Service
CommunityWorkplace reserves the right to modify, update, suspend, or discontinue any features or services offered on the platform, temporarily or permanently, at any time, with or without notice, where feasible.
12. Disclaimer of Warranties
THE COMMUNITYWORKPLACE PLATFORM AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED to IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COMMUNITYWORKPLACE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
13. Limitation of Liability
CommunityWorkplace doesn't guarantee the accuracy, completeness, or reliability of any listings or content posted by users, nor the conduct of any users on the platform. To the maximum extent permitted by law, CommunityWorkplace shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or goodwill, arising from your use or inability to use the platform, even if advised of the possibility of such damages.
14. Payment Security
For the security and peace of mind of our subscribers, all payment transactions on the CommunityWorkplace platform are processed through Wix's secure payment infrastructure. Wix is PCI DSS Level 1 compliant, which is the highest level of security certification in the payment card industry. This means that your sensitive payment information, such as credit card numbers and CVV codes, is encrypted and handled directly by Wix's secure systems and is never stored on CommunityWorkplace's servers or accessible to us in plain text. Your payment details are transmitted using industry-standard encryption protocols (SSL/TLS) to ensure their confidentiality and integrity.
15. Data Backup and Retention
While CommunityWorkplace maintains standard backup procedures, you are solely responsible for maintaining your own backups of Your Content and any other data you deem critical. CommunityWorkplace will not be liable for any loss or corruption of Your Content. Upon termination, CommunityWorkplace reserves the right to delete Your Content from its servers within a reasonable timeframe, as further detailed in our Privacy Policy.
16. Force Majeure
Neither party shall be liable for any failure or delay in performance under these Terms (other than for the payment of money due and payable) due to causes beyond its reasonable control, including but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, pandemics, strikes or shortages of transportation facilities, fuel, energy, labor or materials, or failures of telecommunications or internet service providers (a "Force Majeure Event"). The time for performance of such party shall be extended for a period equivalent to the duration of the Force Majeure Event.
17. Independent Relationship
You acknowledge and agree that your organization's use of the CommunityWorkplace platform creates an independent contractor relationship between your organization and CommunityWorkplace. Nothing in these Terms shall be construed as creating an employer-employee relationship, partnership, joint venture, agency, or any other form of legal association between your organization (or its members) and CommunityWorkplace. You are solely responsible for your operations, content, and interactions with your members and other third parties. CommunityWorkplace acts solely as a service provider to your organization, offering a platform for your use.
18. Acceptance of Terms
By subscribing to or using the CommunityWorkplace platform, you explicitly confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
